This policy is governed primarily by the Protection of Personal Information Act 4 of 2013 (POPIA) and the Electronic Communications and Transactions Act 25 of 2002 (ECTA). We are committed to full compliance with POPIA and all related regulations.
Please read this policy carefully. By accessing or using the Site, you acknowledge that you have read and understood this policy. If you do not agree with any part of this policy, please do not access the Site or submit any personal information to us.
We reserve the right to update this policy at any time. The Effective Date at the top of this document will reflect the date of the most recent revision. Continued use of the Site following any update constitutes acceptance of the revised policy. We encourage you to review this policy periodically.

3. What Personal Information We Collect
We collect personal information only to the extent necessary for the purposes described in this policy. The categories of personal information we may collect include:
3.1 Information You Provide Directly
- Identity information — first name, last name, company or organisation name
- Contact information — email address, telephone number, physical address
- Account information — username, password (stored in encrypted form)
- Academic and enrolment information — programmes enrolled in, academic progress, course completion status, assessment results, and academic certificates issued
- Transaction information — programmes and courses purchased, order history, payment confirmation references, and invoice details
- Communications — messages, enquiries, support requests, and feedback submitted to us
- Survey and competition data — information provided when participating in surveys, competitions, or promotions
3.2 Information Collected Automatically
- Technical data — IP address, browser type and version, operating system, device type, screen resolution
- Usage data — pages visited, time spent on pages, links clicked, referring URLs, access times
- LMS data — course access records, progress milestones, and completion data collected through the learning management system
- Cookie data — information collected through cookies and similar tracking technologies as described in Section 11
3.3 Information from Third Parties
- Social media data — if you connect your account to a social media platform, we may receive your name, email address, profile picture, and other information you have made publicly available on that platform
- Payment processor data — we do not store financial information. All payment data is processed and stored by our payment processors. See Section 7 for details.
You are not obliged to provide us with personal information. However, refusing to do so may prevent you from enrolling in programmes or accessing certain features of the Site.
4. Lawful Basis for Processing
In accordance with POPIA, we process your personal information only where we have a lawful basis for doing so. The lawful bases on which we rely include:
- Consent — where you have given us clear, informed consent to process your personal information for a specific purpose, such as subscribing to our newsletter or accepting cookies
- Contractual necessity — where processing is necessary to perform a contract with you or to take steps at your request prior to entering into a contract, such as processing an enrolment or delivering a programme
- Legal obligation — where processing is necessary to comply with a legal obligation, such as retaining financial records for tax purposes
- Legitimate interest — where processing is necessary for our legitimate business interests, provided those interests are not overridden by your rights. This includes fraud prevention, network security, and improving our services
- Protection of vital interests — where processing is necessary to protect your vital interests or those of another person
5. How We Use Your Personal Information
We use your personal information for the following purposes:
- To create and manage your student account on the Site
- To process and confirm enrolments, payments, and transactions
- To deliver the academic programmes and courses you have enrolled in
- To manage your access to the learning management system (LMS) and track your academic progress
- To issue academic certificates, transcripts, and related records upon completion
- To communicate with you regarding your account, enrolments, or service requests
- To send you newsletters, promotional communications, and updates where you have consented to receive them
- To respond to your enquiries, complaints, and support requests
- To administer competitions, promotions, surveys, and giveaways
- To analyse usage trends and improve the Site and our services
- To detect, prevent, and investigate fraud, security breaches, and illegal activity
- To comply with applicable legal obligations and respond to lawful requests from authorities

We do not sell your personal information to third parties. We may share your personal information in the following circumstances:
6.1 Service Providers and Operators
We share personal information with trusted third-party service providers who process information on our behalf, including hosting providers, payment processors, email delivery services, analytics providers, and customer support tools. These parties are contractually bound to process your information only as instructed by us and in accordance with POPIA.
6.2 Payment Processors

6.3 Legal Requirements
We may disclose your personal information where required to do so by law, court order, or lawful request from a regulatory authority, including the Information Regulator of South Africa, the South African Police Service, or any other competent authority.
6.4 Business Transfers
If RWUni undergoes a merger, acquisition, or sale of all or a portion of its assets, your personal information may be transferred to the successor entity. We will notify you of any such transfer and any material changes to how your information is handled.
6.5 Protection of Rights
We may share your personal information where we believe it is necessary to investigate, prevent, or take action regarding potential violations of our policies, suspected fraud, or situations involving a threat to the safety of any person.
7. Financial Information and Payment Processing
RWUni does not collect, store, or process financial information such as credit card numbers, bank account details, or other payment credentials. All financial transactions are handled directly by our payment processors using secure, encrypted payment infrastructure. We receive only a transaction confirmation and the information necessary to fulfil your enrolment.
8. Data Retention
We retain your personal information only for as long as necessary to fulfil the purposes for which it was collected, or as required by law. Our general retention guidelines are:

When personal information is no longer required, we will delete or anonymise it securely.
9. Cross-Border Transfers of Personal Information
Some of our service providers and technology partners are located outside the Republic of South Africa. Where we transfer your personal information to a third country, we do so in accordance with Section 72 of POPIA, which requires that the recipient country or organisation provides an adequate level of protection for personal information comparable to that required under POPIA.
Where we transfer personal information outside South Africa, we ensure appropriate safeguards are in place, including contractual protections with the receiving party. By using the Site, you consent to the transfer of your personal information outside South Africa where necessary for the delivery of our services.
10. Your Rights as a Data Subject
Under POPIA, you have the following rights in relation to your personal information:
- Right of access — you have the right to request a copy of the personal information we hold about you
- Right to correction — you have the right to request that we correct any inaccurate or incomplete personal information we hold about you
- Right to deletion — you have the right to request that we delete your personal information where it is no longer necessary for the purposes for which it was collected, subject to any legal obligation to retain it
- Right to object — you have the right to object to the processing of your personal information on grounds relating to your particular situation, or where processing is for direct marketing purposes
- Right to withdraw consent — where processing is based on your consent, you have the right to withdraw that consent at any time without affecting the lawfulness of processing prior to withdrawal
- Right to lodge a complaint — you have the right to lodge a complaint with the Information Regulator of South Africa if you believe we have processed your personal information unlawfully

11. Cookies and Tracking Technologies
11.1 What Are Cookies?

14. Social Media
Where the Site allows you to connect your account with a third-party social media account, you authorise us to access certain information from that account as permitted by the social media platform and your privacy settings on that platform. We do not control the privacy practices of social media platforms. Your relationship with these platforms is governed by their own terms and privacy policies.

The Site is not directed at children under the age of 18. We do not knowingly collect personal information from children under 18. We may use your personal information to send you marketing communications, including newsletters, programme updates, and promotional offers, where you have consented to receive them or where we have a legitimate interest in doing so.
You have the right to opt out of direct marketing communications at any time by:

Once you opt out, we will cease sending marketing communications within a reasonable time. Opting out of marketing communications does not affect transactional communications related to your account, enrolments, or academic records.
17. Account Information and Data Access
You may review, update, or correct your account information at any time by logging into your account settings. To request deletion of your account or your personal information, please contact us at info@rwuni.com. Upon deletion of your account, we will deactivate and remove your personal information from our active systems, subject to any legal obligation to retain certain records, including academic records and financial records.
18. Automated Decision-Making
We do not currently make decisions about you based solely on automated processing that produce legal or similarly significant effects. If this changes, we will update this policy and notify you accordingly.
19. Governing Law
This Privacy and Cookie Policy is governed by the laws of za, with particular reference to the Protection of Personal Information Act 4 of 2013 (POPIA) and the Electronic Communications and Transactions Act 25 of 2002 (ECTA). Any disputes arising from this policy shall be subject to the jurisdiction of the South African courts.
